The government has said the scheme will be mandatory across the whole of England, delivered primarily online, and designed to be as light touch, low cost and simple to use as possible (GOV.UK, DCMS).

It will give councils reliable data on how many short lets there are and where, and it will underpin compliance with the health and safety rules that apply to every short let today.

What the register is not

It is a register, not a licence and not planning permission. That is guidance rather than a legal requirement, but no owner should be without it.

If all of that is current, you are in good shape whatever the final rules ask for. If it isn’t, now is the time to fix it, because the register will give councils a far clearer picture of which homes are being let and by whom.

Do existing holiday lets get grandfather rights?

Owners ask us about this a lot, so here is where things stand.

Nothing published so far gives existing lets grandfather rights on the register. Expect every short let, old or new, to need registering unless the final rules set an exemption; the government has said it is considering a threshold for people who let their home only occasionally. Registering early is unlikely to lock in any extra rights.

Planning is a separate question

The idea of grandfather rights comes from planning, which is a separate issue. In February 2024 the previous government said it would create a new planning use class for short lets, and that existing dedicated short lets would be moved into it automatically without needing a planning application (GOV.UK, 19 February 2024). That has never been made law in England. The current government says it is still considering what extra powers to give councils over short lets, and has not committed to any planning change for England.

Why a track record still matters

A track record still matters, though. Scotland’s licensing scheme let hosts who were already operating carry on while their licence applications were decided, while new hosts needed a licence first. England’s 2024 planning proposal would have moved existing short lets into the new class automatically. If planning controls do arrive in England, owners who can show a clear, continuous history of letting, backed by compliant paperwork, are likely to be in a stronger position. That record has to be built now; it cannot be created after the rules change.

What the register means for Brighton, Hove and Sussex owners

The register is national. The government has said it will be mandatory across the whole of England, so it will apply in Brighton and Hove, Worthing, Shoreham and Eastbourne in the same way as everywhere else. There is no local version to wait for.

It sits alongside planning, not in place of it. Government guidance says your local planning authority decides whether you need planning permission, based on how the property is used for short term letting and its impact on neighbours and the local area, and tells owners to contact their council to confirm. It also suggests asking your council whether any additional local rules apply.

Brighton and Hove City Council’s own guidance on short term holiday lets says you might need planning permission to use a living space as a short term holiday let, depending on how far the use changes, and suggests taking legal advice. It also says private sector housing licensing cannot be applied to short term holiday lets.

Like every council in England, Brighton and Hove City Council will get a far clearer picture of which homes are being let and by whom once the register is running. If your paperwork has gaps, that is a good reason to close them now.

We follow this closely. In September 2026 we were part of an STAA delegation to Brighton and Hove City Council on short let regulation, and we will update this guide as the detail is published.

How My Getaways helps

Compliance documents on file. We hold the gas, fire and electrical safety documents for every property we manage, so when registration opens the evidence is ready.

A clear trading history. Every booking we take is recorded, so each property has a documented record of how and when it has been let.

Help with registration. When registration opens we can handle it for you, so you are not left to make sense of a new government system on your own. A fire risk assessment, a gas safety check and an electrical report all need booking with qualified people, and any work they flag has to be finished before you have a clean set of paperwork. Every short let owner in England is working towards the same date, so the closer March gets, the harder those appointments are likely to be to find.

If you have been thinking about professional management, now is the time to make the move, not next spring. Owners who join us before the end of January give us time to review every document, arrange anything that is missing and have the property ready well before registration opens.

If you manage your own let or you are with another agent, get in touch with the My Getaways team.
