My Cover

1. DEFINITIONS
In these terms and conditions, the following definitions apply:
1.1 "Booking" means a confirmed booking for Accommodation with My Getaways Limited.
1.2 "Booking Terms" means the Guest Booking Terms and Conditions of My Getaways Limited, as amended from time to time.
1.3 "Cover Period" means the period commencing at the published check-in time on the first day of the Booking and ending at the published check-out time on the final day of the Booking.
1.4 "Damages Deposit" means the refundable damages deposit that would otherwise be payable for the Booking in accordance with clause 5.1 of the Booking Terms.
1.5 "My Cover" means the deposit indemnity cover product described in these terms and conditions.
1.6 "My Cover Fee" means the fee payable by You to purchase My Cover, as displayed at the time of Booking.
1.7 "Property" means the accommodation booked through My Getaways Limited as identified in the Booking Confirmation.
1.8 "We", "Us", "Our" means My Getaways Limited, trading as mygetaways.co.uk, registered in England and Wales with company number 09726775.
1.9 "You", "Your" means the lead guest who has purchased My Cover.
2. WHAT IS MY COVER?
2.1 My Cover is a deposit indemnity product offered by My Getaways Limited. It is not an insurance policy. My Cover is administered directly by My Getaways Limited and is not regulated by the Financial Conduct Authority.
2.2 Where My Cover is available for a Booking, You may elect to purchase it at the time of Booking as an alternative to paying the full Damages Deposit. If You purchase My Cover, You will not be required to pay a separate Damages Deposit for that Booking.
2.3 My Cover provides indemnity cover for accidental damage to the Property and its contents during the Cover Period, up to the value of the Damages Deposit that would otherwise have been payable.
3. ELIGIBILITY
3.1 My Cover is available at Our discretion. Not all Bookings will offer the option to purchase My Cover.
3.2 My Cover must be purchased at the time of Booking. It cannot be purchased after the Booking has been confirmed.
3.3 My Cover applies to one Booking only. If You make multiple Bookings, each requires its own separate My Cover purchase (if available and desired).
4. WHAT IS COVERED
4.1 My Cover provides indemnity for the following types of accidental damage occurring during the Cover Period, up to the maximum value of the Damages Deposit:
4.1(a) accidental damage to furnishings, fixtures, fittings or decorations in the Property;
4.1(b) accidental breakage of household items, including crockery, glassware and kitchen equipment;
4.1(c) accidental staining or damage to carpets, rugs, upholstery or soft furnishings;
4.1(d) lost or damaged keys, fobs or access devices;
4.1(e) accidental damage to appliances or electronic equipment in the Property; and
4.1(f) minor accidental damage to walls, doors, or flooring.
4.2 For the avoidance of doubt, "accidental" means damage that is unintentional, unforeseen and not caused by negligence, recklessness or deliberate conduct.
4.3 The maximum amount payable under My Cover for any single Booking shall not exceed the value of the Damages Deposit that would otherwise have been payable for that Booking.
5. WHAT IS NOT COVERED
5.1 My Cover does not cover, and You remain fully liable for, the following:
Deliberate and Malicious Conduct
5.1(a) Malicious, deliberate or reckless damage to the Property or its contents.
5.1(b) Damage caused by the use or possession of illegal substances (including, without limitation, nitrous oxide canisters).
5.1(c) Damage caused by use of glitter, confetti, spray-tanning products, or similar substances inside the Property.
5.1(d) Damage caused by smoking inside the Property.
5.1(e) Damage caused by unauthorised pets.
5.1(f) Theft of any items from the Property.
Antisocial Behaviour and Noise
5.1(g) Any charges arising from noise call-outs by Our security patrol, as set out in clause 5.4 of the Booking Terms.
5.1(h) Any charges arising from antisocial behaviour, including complaints from neighbours attributable to You or Your group's conduct.
5.1(i) Any charges arising from the holding of unauthorised parties at the Property.
Breach of Booking Terms
5.1(j) Unauthorised late check-outs and any associated charges.
5.1(k) Any charges arising from exceeding the pre-booked maximum occupancy.
5.1(l) Any charges arising from under-21 group bookings not authorised by My Getaways.
Cleaning and Condition
5.1(m) Excess cleaning charges arising from a failure to leave the Property in a reasonable condition.
5.1(n) Disposal charges for excessive rubbish or unwanted personal items left at the Property.
Other Exclusions
5.1(o) Any damage or loss arising outside the Cover Period.
5.1(p) Any damage caused by Force Majeure (as defined in the Booking Terms).
5.1(q) Any liability that exceeds the maximum cover value set out in clause 4.3.
5.1(r) Any loss, damage or cost not directly related to physical damage to the Property or its contents.
5.2 Where an incident falls within the exclusions set out in this clause 5, We reserve the right to charge the applicable amount to the credit or debit card used for the Booking, following Your check-out. The charges set out in clauses 5.4 and 5.5 of the Booking Terms shall apply.
6. HOW MY COVER WORKS
6.1 If You purchase My Cover at the time of Booking:
6.1(a) You will pay the My Cover Fee in addition to the cost of Your Accommodation.
6.1(b) You will not be required to pay a separate Damages Deposit.
6.1(c) In the event of accidental damage covered by My Cover occurring during the Cover Period, We will not seek to recover the cost of that damage from You, up to the maximum cover value.
6.2 If accidental damage occurs during Your stay:
6.2(a) You must notify Us as soon as reasonably practicable, and in any event before check-out, of any damage to the Property or its contents.
6.2(b) We will assess the damage. If We determine, at Our reasonable discretion, that the damage is accidental and falls within the scope of My Cover, no charge will be made to You for that damage (up to the maximum cover value).
6.2(c) If We determine that the damage falls outside the scope of My Cover (for example, because it was caused by deliberate or reckless conduct), We will notify You of Our determination and may charge the applicable amount to the credit or debit card used for the Booking.
6.3 Our determination as to whether damage is covered by My Cover shall be made in good faith and at Our reasonable discretion. If You disagree with Our determination, You may raise a complaint in accordance with the complaints procedure set out in the Booking Terms.
7. MY COVER FEE
7.1 The My Cover Fee is displayed at the time of Booking and varies depending on the Property and the value of the Damages Deposit.
7.2 The My Cover Fee is non-refundable in all circumstances, including (without limitation):
7.2(a) cancellation of the Booking (whether by You or by Us);
7.2(b) early departure;
7.2(c) no damage occurring during the stay; or
7.2(d) termination of the Booking under clause 11 of the Booking Terms (behaviour).
7.3 The My Cover Fee is inclusive of VAT where applicable.
8. CLAIMS AND DISPUTES
8.1 In the event of a dispute regarding whether damage is covered by My Cover, We will review the matter and provide You with a written determination, including the reasons for Our decision.
8.2 If You are dissatisfied with Our determination, You may:
8.2(a) raise a formal complaint with Us in accordance with clause 19 of the Booking Terms; or
8.2(b) pursue the matter through the courts of England and Wales.
8.3 Where damage is the subject of a dispute, We may withhold any determination until such time as We have had a reasonable opportunity to inspect the Property and assess the damage. We will endeavour to conclude any such assessment within fourteen (14) days of the end of the Cover Period.
9. TERMINATION OF MY COVER
9.1 My Cover automatically terminates at the end of the Cover Period (i.e. at the published check-out time on the final day of the Booking).
9.2 My Cover will also terminate immediately if:
9.2(a) the Booking is cancelled (whether by You or by Us); or
9.2(b) the Booking is terminated under clause 11 of the Booking Terms (behaviour).
9.3 Upon termination of My Cover under clause 9.2, the My Cover Fee remains non-refundable. You will also be liable for any damage to the Property as if My Cover had not been purchased.
10. LIMITATION OF LIABILITY
10.1 My Cover is a deposit indemnity product only. It does not constitute an insurance policy and is not regulated by the Financial Conduct Authority.
10.2 Our total liability under My Cover shall not exceed the value of the Damages Deposit that would otherwise have been payable for the Booking.
10.3 Nothing in these terms shall exclude or limit Our liability for death or personal injury caused by Our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
10.4 Nothing in these terms affects Your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
11. RELATIONSHIP WITH BOOKING TERMS
11.1 These My Cover terms and conditions are supplemental to, and should be read together with, the Booking Terms. In the event of any conflict between these terms and the Booking Terms, the Booking Terms shall prevail.
11.2 All definitions used but not defined in these terms shall have the meanings given to them in the Booking Terms.
11.3 The provisions of the Booking Terms relating to liability (clause 16), data protection (clause 17), governing law and jurisdiction (clause 23), waiver (clause 22), severance (clause 21), and third-party rights (clause 20) apply to My Cover and are incorporated into these terms by reference.
12. GENERAL
12.1 We reserve the right to amend these terms and conditions from time to time. The version in force at the time You purchase My Cover shall apply to Your Booking.
12.2 These terms and conditions, together with the Booking Terms, constitute the entire agreement between You and Us in respect of My Cover and supersede all previous discussions, correspondence, negotiations and agreements relating to My Cover.
12.3 These terms and conditions are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with them.
